CALL FOR PAPERS: JUDICIAL REFORMS IN CENTRAL AND EASTERN EUROPE, UNIVERSITE LIBRE DE BRUXELLES

CALL FOR PAPERS: JUDICIAL REFORMS IN CENTRAL AND EASTERN EUROPE,

UNIVERSITE LIBRE DE BRUXELLES (GASPPECO), 17th November 2006

Research in the field of post-communist transformations in Central and Eastern Europe has evolved significantly over the last past years. The proliferation of studies concerning this topic could be easily explained by the scale of transformations occurring in the post-communist states. The triple transition announced by the scholarly community at the beginning of the 90’s is in fact multidimensional. The simultaneity of these transformations, their inscription in the courte durée and their shifting character, as well as the interaction between the internal and external factors in these processes of change constitute a challenge for the academic community. The accession of these countries to the European Union has encouraged the development of the academic literature, mainly focused on the impact of the European integration on the domestic politics, polities and policies.

The GASPPECO (Groupe d’analyse socio-politique des pays d’Europe centrale et orientale) wishes to organise on17th of November 2006 an international conference on the judicial reforms in Eastern Europe. The judicial independence, which represents the aim of these reforms, occupies an important place in the literature regarding the democratisation or the consolidation of democracy in this part of Europe. The judicial independence is at the same time one of the political conditions established by the European Union’s institutions for the eastern enlargement. Consequently, the judicial independence is part of the democratic conditionality.
The first years after the collapse of the communism, the process of transition in the field of the judiciary has aroused an important number of research questions. The drafting process of new Constitutions, the role of the western models and experts in these processes, the new institutional architecture represent a starting point in the development of the literature. These first studies present the external factors as the main explanatory variable, both in analyses focused on the substance of these reforms and in studies concerning the processes of change. Nevertheless, we know very little about these internal processes of transformation and we have a poor understanding of interest politics in post-communist democracies.

The main aim of this international conference is to enlarge this research agenda in order to pay a particular attention to the internal actors and institutions involved in this process of change. The conference’s purpose is to encourage a comparative perspective on the judicial reforms in Central and Eastern Europe, and to bring together political studies, law and European studies in order to better understand these transformations.
Even if the goal of the conference is to analyse, in a public policy approach, the judicial reform in these countries in order to ensure the independence of those systems, a particular attention will be paid to the “democratic unity of power” before 1989.

The following issues will be addressed:
1. “The democratic unity of power” or the politicization of the judiciary in the communist Central and Eastern Europe

In the opening section of the conference we are interested in examining the characteristics of the communist judicial systems in these countries. The construction of the judicial power and the different forms of politicization are just two axes of reflection. This section would like to depict the similarities and the differences emerging across the region and the legacies of the past in the process of reform started at the beginning of the 90’s.

2. The politics of the judicial reform in Central and Eastern Europe in the context of the EU accession
The second section of the conference focuses on the judicial reforms after 1989 and in the context of the EU accession. The aim is to analyse the substance of these reforms, the meaning of the “judicial independence” and the role played by the domestic political and social actors in this process of change, from the phase of agenda setting and until the implementation of these political outputs.
The languages of the conference are French and English.
The contributions presented at the conference will be published in a collective book edited by Jean-Michel De Waele and Ramona Coman.
We expect both empirically driven and theoretically informed papers.
The applications for the conference (drafted in French or in English) should be sent by the 31th of March 2006. Paper proposals should not exceed 300 words. A short CV, information about institutional affiliation, status should also be included.

APPEL A CONTRIBUTIONS: LES REFORMES JUDICIAIRES DANS LES PAYS D'EUROPE CENTRALE ET OREINTALE, UNIVERSITE LIBRE DE BRUXELLES, GASPPECO, le 17 NOVEMBRE 2006
