CONFERENCE ON THE LAW AND ECONOMICS OF PURE ECONOMIC LOSS
2004-09-15 17:27
Universitat Pompeu Fabra, Barcelona, 7-9 April 2005
CALL FOR PAPERS
The Conference on the Law and Economics of Pure Financial Loss, organized by the Universitat Pompeu Fabra and the International Review of Law and Economics, will take place at the Law School of the Universitat Pompeu Fabra, Barcelona, Spain, on 7-9 April 2005.
The legal status and treatment of economic losses in many jurisdictions, both in the Civil Law and the Common Law traditions, have puzzled lawyers and economically minded scholars for a long time. Moreover, the size and reach of economic losses are in the rise in modern economies and legal systems, due to technological developments in telecommunications, network effects, increased value of financial information, expanded use of informational intermediaries, the augmented role of gatekeepers, and similar phenomena.
There is already a vast academic literature, ranging from comparative Law to economic analysis of Law, from Tort Law to business organization, dealing with pure economic losses. We believe, however, that many issues, dimensions, and new developments associated with pure economic losses remain unexplored. The School of Law of Universitat Pompeu Fabra, and the International Review of Law and Economics have decided to organize an international Conference on the Law and Economics of Pure Economic Loss, aiming at lawyers, economists, and other social scientists interested in the topic.
We invite the submission of papers and proposals on any issue related to pure economic losses, and in particular on
-Liability of auditors, investment banks, and financial experts
-Class actions for recovery of financial loss
-Contract/tort boundaries in economic losses
-Distribution vs. efficiency in economic losses, and the role of public compensation systems
-Legal harmonization in the Law of pure economic losses
A selection of the papers presented at the Conference will be published in a special issue of the International Review of Law and Economics.
Papers and proposals (2 pages long) should be in English, and should be submitted electronically, in pdf or word formats, as attachment to an e-mail message addressed to pure.economicloss@upf.edu, no later than 15 November 2004.
The selection of the papers will be made by a special panel composed of Avery Katz (Columbia Law School), Hans-Bernd Schдfer (Universitдt Hamburg), Francesco Parisi (George Mason University School of Law), Pablo Salvador (Universitat Pompeu Fabra), and Fernando Gomez (Universitat Pompeu Fabra). Acceptance of proposals will be communicated by January 15 2005, and completed papers should be sent, in the same way as the proposals, by March 1 2005.
